By entering your name, credit card information, or otherwise enrolling electronically, you agree to be provided with products, programs, or services by Nichole Andrews, RDN acting on behalf of Nutrition with Nichole, LLC subject to the following terms and conditions:
Upon execution of this Agreement, electronically, verbally, or otherwise, the Instructor agrees to provide services in accordance with Cancer Simplified consisting of a monthly or annual premium subscription, and private self paced training access, menus, and guest speakers. All members get question support via Kajabi training in the comment section unless they cart bump with their annual purchase to join the private FB group. Messages through Instagram will be directed to the comments section of Kajabi or the private FB group if they paid the annual membership fee and enrolled for CS FB access. Instructor reserves the right to substitute services equal to or comparable to the Program for Client if reasonably required by the prevailing circumstances. Client is responsible for his/her own success and implementation of objectives met. Instructor reserves the right to remove Client from Program at any time for any reason.
NO SHARING: You cannot distribute, copy, forward, and/or share the Membership or its content with anyone else or any third parties. Any violations of these Terms of Use will be legally pursued to the fullest extent permitted by law.
PAYMENT, UPGRADES AND REFUND POLICY: We will do everything within our ability (and within reason) to ensure your satisfaction. Due to the downloadable nature of Cancer Simplified membership, refunds will not be provided for any subscription for any circumstance. We do not offer refunds or credits for unused subscription periods, accidental purchases, medical conditions, or any similar reason or event. If you have any questions or concerns, or if there is anything we can do to make your experience a more pleasant one, please email our support team at [email protected]. To purchase Cancer Simplified membership, you will complete the purchase, which includes payment of a minimum of the initial time commitment, and create your membership profile in order to access the materials. You will be in accordance with the program you selected for Cancer Simplified membership. Membership may be canceled at any time after your purchase however, no refunds will be authorized after fees have been charged. To avoid incurring additional fees, you must cancel your membership prior to the next billing date. To cancel your membership level, email [email protected]. Your access to the Membership will be disabled at the expiration of the period for which you have already paid. Please give us 5 business days to support you if you need assistance to process your cancellation. This means that last minute cancellations may not be processed in time before your subscription renews. Once you cancel your subscription, you lose access to all Cancer Simplified materials, trainings, and FB access as well.
INTELLECTUAL PROPERTY RIGHTS: In respect of the documents specifically created for the Client as part of this Program, the Instructor maintains all of the copyright, other intellectual property rights and any other data or material used or subsisting in the Material whether finished or unfinished. Client receives one license for personal use of any content provided by the Instructor. Nothing in this Agreement shall transfer ownership of or rights to any intellectual property of the Instructor to the Client, nor grant any right or license other than those stated in this Agreement. The Instructor reserves the right to immediately remove Client from the Program, without refund, if you are caught violating this intellectual property policy.
NON-DISPARAGEMENT. The Parties agree and accept that the only venue for resolving a dispute shall be in the venue set forth herein below. The Parties agree that they neither will engage in any conduct or communications with a third party, public or private, designed to disparage the other. Neither Client nor any of Client’s associates, employees or affiliates will directly or indirectly, in any capacity or manner, make, express, transmit speak, write, verbalize or otherwise communicate in any way (or cause, further, assist, solicit, encourage, support or participate in any of the foregoing), any remark, comment, message, information, declaration, communication or other statement of any kind, whether verbal, in writing, electronically transferred or otherwise, that might reasonably be construed to be derogatory or critical of, or negative toward, the Instructor or any of its programs, affiliates, subsidiaries, employees, agents or representatives.
LIMITATION OF LIABILITY. By using Nutrition with Nichole, LLC services and purchasing this Program, Client accepts any and all risks, foreseeable or unforeseeable, arising from such transactions. Client agrees that Instructor will not be held liable for any damages of any kind resulting from or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the Program. Client agrees that use of this Program is at the user's own risk.
